Ofori-Atta’s lawyers challenge his detention in US court

Legal action has been filed in the United States to challenge the detention of former Finance Minister Ken Ofori-Atta by U.S. Immigration and Customs Enforcement (ICE).

The development was confirmed by Frank Davies, a member of Ofori-Atta’s legal team, during an interview on Joy Prime on January 10, 2026. Davies said Ofori-Atta is currently in ICE custody and that his lawyers, in collaboration with U.S.-based attorneys, have initiated court proceedings to contest the detention.

“Ken Ofori-Atta has been picked up by ICE. We all know he is in custody. What every diligent lawyer would do is to assure himself or herself of the processes attendant on the custody,” Davies stated.

He disclosed that the legal challenge has already been formally filed and is expected to be heard later in January 2026.

“The lawyers in America have filed a process in court to challenge his custody in ICE detention. That process will be heard later this month,” he said.

Davies explained that the legal strategy involves close coordination between lawyers in Ghana and their counterparts in the United States.

“That is why we are here as his lawyers, because we have a collaboration and a teamwork with American lawyers,” he noted.

Providing an update on the case, Davies said the matter is now before the court and awaiting determination.

“The position now is that the lawyers in America have filed a process in court to challenge what ICE has done, and that process will be dealt with very soon,” he added.
